December 8, 2016 - Regular Meeting

The Regular Monthly Meeting of the Montour Township Board of Supervisors was called to order on December 8, 2016 at 7:30 p.m., by Chairman Joseph Mullen.  All members were present. 

The Pledge of Allegiance was recited.                                                                                              

A Moment of Silence was observed.

PUBLIC COMMENT:

John Reibsome questioned the reasoning for repealing the Per Capita tax.

Joe Mullen, Township Chairman, explained that Columbia County will no longer be assisting in the process. There was further discussion.

MINUTES:

A MOTION was made, by Ms. Ebright, seconded by Mr. Bennett, to approve the Minutes of the Regular Monthly Meeting of November 10, 2016. Motion carried.

BILLS DUE FOR PAYMENT:

A MOTION was made by Mr. Bennett, seconded by Ms. Ebright, to approve bills to be paid from the General Fund in the amount of $62,127.95, Special Police Fund $672.64, Sewer Fund $14,438.28, Debit Card Purchases for the month of November in the amount of $327.23, and Fire Tax Fund in the amount of $1,753.46.

 Ratify Sewer Fund check # 4801 for $1,057.00 and check # 4817 for $29.81. General Fund checks # 12102 for $995.26, #12104 for $592.03, #12114 for $2,419.00, # 12115 for $31.05, and # 12129 for $80.46. Motion carried.

OLD BUSINESS:

PUBLIC SEWER:

STP OPERATOR’S REPORT:

John Bauer, Sewer Treatment Plant Operator, was not present.

KURIAN SEWER HOOK UP:

There is nothing new to report.

SEWER COLLECTIONS:

Mr. Mullen stated that the Township is still working on a better process for handling past due accounts. There was further discussion.

BUDGET VS. ACTUAL EXPENSES AND REVENUE UPDATE:

Ms. Ebright reported on the Townships financials.  Everything is doing well.  

FLOOD MITIGATION PROGRAM – UPDATE:

Theresa Hampton, Township Secretary, stated Project 2 will hopefully be completed soon.

CODE OF ORDINANCES UPDATE:

 There is nothing new to report.

LANDLORD REGISTRATION ORDINANCE:

Rich Roberts, Township Solicitor, stated a draft of the Ordinance was given to each Supervisor at the November meeting, for review.

COMPREHENSIVE PLAN AND ZONING MAP:

Planning Chairman Linda Woodward was not present, nothing new to report.

HAZARDOUS WASTE PICK-UP AREA:

There is nothing to report.

SMALL CELL TOWERS:

Solicitor Roberts provided each Supervisor with a draft Ordinance for review.

MS4 STORM WATER REQUIREMENTS:

Mr. Mullen mentioned that a request to excuse the Township from MS4 must be submitted by the end of the month.

NEW BUSINESS:

RESOLUTION TO APPOINT HERRING, ROLL & SOLOMAN FOR 2016 AUDIT:

A MOTION was made by Mr. Mullen, seconded by Ms. Ebright, to accept the Resolution that was read as follows;

RESOLVED, that the Board of Supervisors of Montour Township hereby appoints Herring, Roll & Solomon, P.C. to make an examination of all the accounts of the Township for the fiscal year 2016 at a cost of Five Thousand Eight Hundred Dollars ($5,800.00).

Motion carried.

KLINGERMAN SUB-DIVISION:

A MOTION was made by Mr. Bennett, and seconded by Ms. Ebright, to approve the Klingerman Sub-Division dated October 31, 2016, and revised December 5, 2016. Motion carried.

A MOTION was made by Mr. Bennett, seconded by Ms. Ebright to approve the Cleaver/Mowery Sub-Division, and request for Planning Waiver & Non-Building Declaration, dated October 20, 2016 and revised December 2, 2016. Motion carried.

A MOTION was made by Mr. Mullen, seconded by Mr. Bennett, to approve a reduction of security to Susquehanna RV, from $899,294.00 to the amount of $448,909.17. Motion carried.

2017 BUDGET:

A MOTION was made by Mr. Bennett, seconded by Ms. Ebright, to accept the 2017 Budget.

A MOTION was made by Mr. Mullen, seconded by Mr. Bennett, to accept the Ordinance to Repeal the Per Capita Tax, as read by Solicitor Roberts. Motion carried.

2017 TAX RESOLUTION:

A MOTION was made by Mr. Mullen, seconded by Mr. Bennett to accept the 2017 Tax Resolution with no tax increase. Motion carried.

ZONING OFFICER’S REPORT:

A full report was submitted by Tim Mauk, Zoning Officer.

CODE ENFORCEMENT OFFICER’S REPORT:

A full report was submitted by Tim Mauk, Code’s Enforcement Officer. 

PUBLIC WORKS REPORT:

HOLLOW ROAD CULVERT:

Mr. Mullen stated that an application will be submitted for the Hollow Road culvert.

TOWER DRIVE:

Mr. Mullen stated that work on Tower Road will begin next year.

QUARRY ROAD:

Mr. Mullen stated that an extension was granted due to the lack of laborers.

A MOTION was made by Mr. Mullen, seconded by Mr. Bennett, to use $15,000 from the General to pay toward the backhoe loan principal. Motion carried.

It was mentioned that the Perry Avenue extension proposal is in the process of being completed.

Mike Hinkle, Township Road Foreman, voiced concerns that plowing Colonial Drive is a liability.  There was much discussion on this matter. Ms. Ebright and Mr. Bennett stated they will look into this matter.

A MOTION was made by Mr. Mullen, and Ms. Ebright to accept the resignation of Carmen Calleri as Emergency Management Officer, and to reappoint Joe Yeager. Motion carried.

POLICE DEPARTMENT REPORT:

Chief Eckart submitted a written report of activities for the month of November, 2016.   

A MOTION was by Ms. Ebright, seconded by Mr. Bennett, to hire Craig Johnson as a part time Officer at a rate of $14.50 per hour, with a 6 month probation period, effective immediately. Motion carried.

A MOTION was made by Mr. Mullen, seconded by Mr. Bennett, to hire Cody Clossen, and Brant Morris as part-time Officers, as needed, at a rate of $14.50 per hour, effective immediately, with a 6 month probation period. Motion carried.

 A MOTION was made by Mr. Mullen and seconded by Ms. Ebright to accept the resignation of Corporal Jimmie Hill. Motion carried.

A MOTION was made by Mr. Mullen to accept Corporal Hill’s request to continue as a part-time officer as needed. MOTION failed due to lack of second.

FIRE COMPANY REPORT:

Fire Chief Brian Fosse submitted a written report of Fire Company activities for the month of November, 2016.  

Chief Fosse requested “No Truck/SUV Parking”, to be placed at the two (2) nearest parking spots to the truck bays.

He also requested funds to cover the cost of new equipment that will be repaid when the Fire Company’s USDA loan is received.

PUBLIC COMMENT PERIOD:

Mr. Vanderpool asked the Board how the issue of plowing Colonial Drive will be handled.

Ms. Ebright and Mr. Bennett stated they will be looking into the matter.

Solicitor Roberts mentioned that an executive session will be held following the meeting to discuss possible litigation, and personnel matters. 

MEETING DATE:

Mr. Mullen reported that the Montour Township Board of Supervisors will hold their 2017 Reorganizational Meeting on January 3, 2017 and next Monthly Meeting on January 12, 2017 at 7:30 p.m.

There being no further business to discuss, the Meeting was adjourned at 9:30p.m., on a MOTION of, Ms. Ebright seconded by Mr. Bennett. Motion carried.
