December 10, 2015 - Regular Meeting

The Regular Monthly Meeting of the Montour Township Board of Supervisors was called to order on December 10, 2015 at 7:30 p.m., by Chairman Gerald Powers.  All members were present.

The Pledge of Allegiance was recited.

A Moment of Silence was observed.

Lori Ebright, Township Treasurer expressed her appreciation to Dr. Powers, Township Chairman for his years of service to the Township.  Ms. Ebright presented Dr. Powers with a plaque from Montour Township.

Joe Mullen, Road Master, thanked Dr. Powers for getting him involved with the Township which later led to him being a Supervisor.

Dr. Powers thanked everyone for allowing him to serve the people.

PUBLIC COMMENT:

No Public Comment.

MINUTES:

A MOTION was made, by Dr. Powers, seconded by Mr. Mullen, to approve the Minutes of the Regular Monthly Meeting of November 12, 2015.  Motion carried.

A MOTION was made by Mr. Mullen, seconded by Dr. Powers, to accept the Budget for 2016.  Motion carried.

Dr. Powers announced that the Board held an executive session for the interview of a part-time Police Office.

                                                           

BILLS DUE FOR PAYMENT:

A MOTION was made by Ms. Ebright, seconded by Dr. Powers, to approve bills to be paid from the General Fund in the amount of $35,105.02. Motion carried.

A MOTION was made by Ms. Ebright, seconded by Mr. Mullen, to approve bills to be paid from the Special Police Fund in the amount of $754.98. Motion carried.

A MOTION was made by Mr. Mullen, seconded by Dr. Powers, to approve bills to be paid from the Highway Fund in the amount of $8,408.64. Motion carried.

A MOTION was made by Ms. Ebright, seconded by Mr. Mullen, to approve bills to be paid from the Sewer Fund in the amount of $14,237.96.  Motion carried.

A MOTION was made by Mr. Mullen, seconded by Ms. Ebright, to approve bills to be paid from the Debit Card Account for the month of November in the amount of $140.91.  Motion carried.

A MOTION was made by Dr. Powers, seconded by Mr. Mullen, to approve bills to be paid from the Fire Tax Account in the amount of $1,753.46.  Motion carried.

 

OLD BUSINESS:

PUBLIC SEWER:

STP OPERATOR’S REPORT:

John Bauer, Sewer Treatment Plant Operator reported that there was nothing new to report and all was well.

 

KURIAN SEWER HOOK UP:

There is nothing new to report.

BEVERLY DEITERICH – 5 Perry Avenue Sewer Bill:

Rich Roberts, Township Solicitor stated that he has spoken with Steve Bielskie, who is having trouble retrieving the records for 5 Perry Ave., but is 99% sure that it has been condemned.

A MOTION was made by Mr. Mullen, seconded by Dr. Powers, to forgive any outstanding sewer balance for 5 Perry Ave., with the contingency that the sewer line be capped. Motion carried.

Mr. Mullen will inform Mrs. Deiterich of this decision.

Dr. Powers mentioned that there is an interested buyer for the property. There was much discussion on this topic.

SEWER COLLECTIONS:

There is nothing new to report.

BUDGET VS. ACTUAL EXPENSES AND REVENUE UPDATE:

Ms. Ebright reported on the Townships financials.  Everything is doing well.

Ms. Ebright stated that the township income is more than budgeted, which is good and that the total income and expenses are right on track with the expected budget. 

FLOOD MITIGATION PROGRAM – UPDATE:

Theresa Hampton states that the Township has a new FEMA representative who is working to close the case.  He has asked for information on Project 1 and will soon begin work on Project 2.

CODE OF ORDINANCES UPDATE:

Linda Woodward, Planning Commission Chairperson, reported that Kathy Hunter has sent a proposal for a Code of Ordinances update for the amount of $3,900. It was also reported that General Code’s cost will range from $887 to $11,000.

Mr. Mullen suggested putting in writing what the Township would like to have done, in order to get a better estimate of the cost.

Solicitor Roberts stated that the Township will first need a completed Comprehensive Plan, next an updated Zoning Ordinance, and lastly an updated Code of Ordinances.

 

LANDLORD REGISTRATION ORDINANCE:

There is nothing new to report.

COMPREHENSIVE PLAN AND ZONING MAP:

Solicitor Roberts mentions that he is still waiting for maps and appendices’ from Michelle Brummer. Once he obtains them, they will be sent for review to various entities that will have 45 days to consider them.  A Hearing will then be held, which needs to be advertised once a week for two weeks prior to the Hearing.  At that time the Comprehensive Plan may be adopted.

Dr. Powers thanked Ms. Woodward and the Planning Commission for the commendable job they have done on the Comprehensive Plan.

There was discussion over Gerry Walls, Planning Commission Consultant, and his contract.   Ms. Woodward mentioned that Tim Mauk, Township Zoning Officer, recommended John R. Varaly, A.I.C.P., for the position.  It was stated that the Planning Commission recommends Mr. Walls’ contract be extended to July 2016 to prevent any lapse in the position, at that time both candidates can present the Board with credentials and proposed contracts for consideration.  Ms. Woodward mentions that Mr. Walls’ contract will remain the same with the exception of his cost, which will go from a $1,200 to $1,300 retainer. There was further discussion on this topic.

HAZARDOUS WASTE PICK-UP AREA:

There is nothing new to report.

SMALL CELL TOWERS:

There is nothing new to report.

 

EMERGENCY WATER SOURCE:

There is nothing new to report.

                

EMA DIRECTOR:

There is nothing new to report.

Mr. Mullen mentions that Montour Township was able to submit a previous EMP 5 year Plan, with only a few updates needed.

BROUSE/SUSQUEHANNA VALLEY RV LAND DEVELOPMENT PLAN:

Max Stoner, Township Engineer was not present. 

 Solicitor Roberts, states that Wayne Brouse has submitted a request for a 90 day extension.

Ms. Woodward speaking on behalf of the Planning Commission recommends the extension be accepted.

A MOTION was made by Dr. Powers, seconded by Mr. Mullen to approve a 90 day extension made by Mr. Brouse. Motion Carried.

LIGHT FOR TOWNSHIP FLAGPOLE:

Mike Hinkle, Road Foreman, is not present. 

Mrs. Hampton stated that she has spoken with Mr. Hinkle, who has been in contact with the electrician and doesn’t think there will be any issues adding a dual light.  Mr. Hinkle does not have a date for the installation as the electrician is busy at this time.

 

EMILY DEWALD RETIREMENT-AACOUNTANT REPLACEMENT:

Solicitor Roberts stated he spoke with a colleague about the open position, but they are not taking on new accounts at this time.  Solicitor Roberts suggested calling Herring & Roll & Soloman.

Mr. Mullen mentions that there is an accountant who is a resident and employee of Hemlock Township, who he will call as well.

NEW BUSINESS:

2016 BUDGET:

A MOTION was made by Dr. Powers, seconded by Ms. Ebright to accept the 2016 Budget. Motion carried.

2016 TAX RESOLUTION:

A MOTION was made by Dr. Powers, seconded by Mr. Mullen to accept the 2016 Tax Resolution with no tax increase. Motion carried.

CODE ENFORCEMENT OFFICER’S REPORT:

Nick Fritz, Code Enforcement Officer, reports that a citation was filed to James Knorr for the excessive brush at Montour Blvd & Perry Ave. Mr. Knorr complied and the citation was withdrawn.

Mr. Fritz states that the mess at 522 Montour Blvd. Lot 36 has been cleaned up. He asked if the property owner can be held responsible in the future.

Solicitor Roberts states that the property owner can be held responsible.

Ms. Ebright commends Mr. Fritz for his hard work and quick response when questions and concerns arise.

A Peddlers Permit was issued to Mr. Bietz for sale of Christmas trees. 

There was a report on Grovania Dr. of a horse barn on the Mench property that receives its power via an extension cord from another barn on the property.  Mr. Fritz spoke with Steve Belski who said that is a code violation.  The barn must be wired direct from the other barn or a new service needs to be put in.

 

 

ZONING OFFICER’S REPORT:

Tim Mauk, Zoning Officer, reported the following permits issued:

K. Unger---Home Construction

J. Hogue----Fencing

N. Petock----Sign Permit

J Bremigen----Building Permit

UGI Utilities Inc. ----Line Repairs

There were no permits denied.

Mr. Mauk mentions that Mr. Brouse has submitted a permit for the temporary storage of Rv’s at 320 Montour Blvd. It was mentioned that there are also trailers being stored at the old motel site. Solicitor Roberts suggests that he submit a temporary permit for those trailers a well.

Solicitor Roberts states there will be a Conditional Use Hearing held on December 22, 2015 for Speed & Sport/Ronald Hileman, trailer relocation.

Mr. Mauk thanked the Supervisors for sending him to a Zoning Course in Conyngham. The course was very informative and well worth his time.

PUBLIC WORKS REPORT:

 

HOLLOW ROAD CULVERT:

There is nothing new to report.

INSURANCE CLAIM:

Mr. Hinkle is asking if a claim can be put in to cover his $500 deductible for damages to his own vehicle, made by a Township vehicle.  

Solicitor Roberts will look into the legalities that surround these circumstances.

Mr. Mullen proposed the Township put out contracts to do full depth reclamations for Upper Tower Road, Quarry Drive, and a small section of Tower Rd. between Valley Rd. and Route 11. There was further discussion on this topic.

POLICE DEPARTMENT REPORT:

Chief Eckart has submitted the following written report of activities for the month of November, 2015:

                                Fines issued - $3,080.00 – Montour Township

                                                        56 Traffic Citations – Montour Township

                                                           21 Traffic Citations – Catawissa Township

                                                           2 Non-traffic Citations – Montour Township

                                                           3 Criminal Arrests – Montour Township

                                                       1 Criminal Arrests – Catawissa Township

                                                         64 Incidents in Montour Township                       

                                                           30 Incidents in Catawissa Township

 

Chief Terry Eckart mentioned that the Blood Drive scheduled for December 23 has been canceled due to a Geisinger scheduling conflict.  It will be rescheduled for some time in March 2016.

Chief Eckart asked if there are any families that appear to be in need please contact him.  They are still looking for a few families to donate Christmas dinner and gifts for the children.

Dr. Powers announced that the Board interviewed Mr. Nick Letcavage for a position as a part time Police Officer.

A MOTION was by Dr. Powers, seconded by Ms. Ebright to hire Mr. Letcavage as a part time Police Officer at the rate $14 per hour with a 6 month probationary period effective at the completion of all employment requirements. Motion carried.

 

FIRE COMPANY REPORT:

Fire Chief Brian Fosse was not present but submitted a written report of Fire Company activities for the month of November, 2015.

PUBLIC COMMENT PERIOD:

Ms. Woodward mentions an upcoming event for newly elected or appointed officials to be held at various locations and dates. She feels this would benefit new officials and well as a refresher for those already in office.  There was discussion on this topic.

MEETING DATE:

Dr. Powers reported that the Montour Township Board of Supervisors will hold their 2016 Reorganizational meeting on January 4th at 7:00 p.m.

There being no further business to discuss, the Meeting was adjourned at 8:45 p.m., on a MOTION of Dr. Powers, seconded by Ms. Ebright.  Motion carried.
