May 14, 2015 - Regular Meeting

The Regular Monthly Meeting of the Montour Township Board of Supervisors was called to order on May 14, 2015, at 7:30 p.m., by Chairman Gerald Powers. All Board members were present.

 

 

The Pledge of Allegiance was recited

 

A Moment of Silence was observed.

 

PUBLIC COMMENT:

Eugene Eddy of 46 Perry Avenue, spoke about a barking dog in the mobile home park behind him.  The dog barks sometimes for an hour or more.  Mr. Eddy spoke with the police and was told that there is no ordinance in place at this time.  He asked if we could look into adopting an ordinance addressing this type of situation. Solicitor Roberts suggested that the owner be talked to and see if there is anything that can be done voluntarily and if not consider an ordinance.   Nancy Powers asked if this problem could be handled via animal control.  Mr. Eddy was told by animal control that they do not deal with that type of problem. Nick Fritz will check to see if there is anything he could do and will report back.

Ms. Ebright introduced Nicole Cummins as the new Township Clerk.

MINUTES:

A MOTION was made by Mr. Mullen, seconded by Mr. Powers, to approve the Minutes of the Regular Monthly Meeting of April 9, 2015.  Motion carried.

BILLS DUE FOR PAYMENT:

A MOTION was made by Mr. Powers, seconded by Ms. Ebright, to approve bills to be paid from the General Fund in the amount of $46,536.14. Motion carried.

A MOTION was made by Mr. Mullen, seconded by Mr. Powers, to approve bills to be paid from the Special Police Account in the amount of $440.09.  Motion carried. 

A MOTION was made by Ms. Ebright, seconded by Mr. Powers, to approve bills to be paid from the Highway Fund in the amount of $2,917.78.  Motion carried.

A MOTION was made by Mr. Power, seconded by Ms. Ebright, to approve bills to be paid from the Sewer Fund in the amount of $14,950.82.  Motion carried.

A MOTION was made by Mr. Mullen, seconded by Mr. Powers, to approve bills to be paid from the Debit Card Account for the month of April in the amount of $148.53.  Motion carried.

A MOTION was made by Mr. Powers, seconded by Ms. Ebright, to approve bills to be paid from the Fire Tax Fund in the amount of $3,500.00.  Motion carried.

 

Mr. Powers mentioned that there were 2 individuals, not from the township, who needed to speak first:

 

JENNI THOMAS BUCHER LAND DEVELOPMENT PLAN:

Rich Williams, attorney for Verizon Wireless, reported that the Zoning Hearing Board gave special exception approval to move forward with their plan.  The plan has been reviewed by the Township Planning Commission and County Planning Commission. Mr. Williams was at this meeting seeking approval from the Supervisors. The proposed tower is expected to be 120 feet high with a 9 foot lightening rod, for a total height of 129 feet. Mrs. Powers asked if this would generate any tax revenue and was told that the tower will be taxed the same as a building.  A MOTION was made by Mr. Powers, seconded by Ms. Ebright to approve the Land Development Plan of Jenni Bucher and Cellco Partnership dated October 31, 2014, last revised February 13, 2015, and received by the Township February 19, 2015, subject to the following conditions:

  1.  Submission of a performance bond in a form acceptable to the Township in the amount of Thirty-four Thousand Sixty-eight dollars and Seventy-five Cents ($34,068.75).
  2. Submission of a tower removal bond in a form acceptable to the Township in the amount of Fifty-six Thousand Five hundred Eighty Dollars ($56,580.00)
  3. Submission of a certificate of general liability insurance naming the Township as an additional insured in the amount of One Million Dollars ($1.000,000,000)
  4. Submission of an Improvements Agreement in a form acceptable to the Township.
  5. Submission of a Stormwater Agreement in a form acceptable to the Township.
  6. Submission of a Right-of-way Use and Maintenance Agreement in a form acceptable to the Township.

  Motion carried.

STONE CASTLE ZONING CHANGE:

Charles Axtman, Engineer for Susquehanna RV (formerly Stone Castle Motel), spoke about the new RV Sales and Service Facility.  They would like to start with the earth moving part of the project as soon as possible and would like the township engineers to review the storm water plans for approval.  They would like to divide the project into 2 stages: the 1st being site work and storm water management.  Solicitor Roberts stated that the township, township engineers and planning commission will review the plans.  Storm water plans have been submitted to the Conservation District.     

HEARING FOR GAS & OIL ORDINANCE:

County Planning Commission had 42 comments / corrections to be made to the Ordinance.  These changes have been reviewed and changes were made.  Solicitor Roberts stated that he recommended the revised Ordinance be presented for adoption. 

PUBLIC COMMENT PERIOD FOR HEARING:

Robert Webber thanked the Supervisors for initiating this idea and for being proactive.  He also thanked Solicitor Roberts and Jerry Walls, stating that they all did a wonderful job.

George Welliver asked if we could get inspection reports.  Solicitor Robert’s opinion is that getting reports is not permissible.

Connie Giger of Ridge Road, asked how Williams would know about the Ordinance. She was told that Williams will have to apply for a permit and will be notified at that time.  

A MOTION was made by Mr. Powers, seconded by Ms. Ebright to adopt an Ordinance amending chapter 27 of the code of Ordinances concerning oil & gas activities.   Motion carried. 

 

OLD BUSINESS:

 

PUBLIC SEWER:

 

STP OPERATOR’S REPORT:

John Bauer, STP Operator, reported everything was fine and that a calibration will be done on the flow meters in a couple of weeks. The pump stations will be backed up in 2-3 weeks.

KURIAN SEWER HOOK UP:

There was nothing new to report.

LETTER FROM T. HOOVER REGARDING CARTWAY SINKHOLES:

Mr. Mullen looked at the area in question.  He phoned Mr. Hoover and told him that the township would take care of fixing the holes. 

BUDGET VS. ACTUAL EXPENSES AND REVENUE UPDATE:

Ms. Ebright reported that the Township budget looks good. 

UNITED WATER SERVICE – UPDATE:

There was nothing new to report.

FLOOD MITIGATION PROGRAM – UPDATE:

We are still working on the close out binders for the final payment.

CODE OF ORDINANCES UPDATE:

Solicitor Roberts reported that we are waiting for the Comprehensive Plan to be completed. Linda Woodward reported that we should expect to have the Plan next month.  The Ordinances can be rewritten at that time. 

LANDLORD REGISTRATION ORDINANCE:

This matter is on hold.

COMPREHENSIVE PLAN AND ZONING MAP:

This matter was addressed under the Code of Ordinances Update.

HAZARDOUS WASTE PICK-UP AREA:

There was nothing to report.

STONE CASTLE ZONING CHANGE:

Linda Woodward reported that this is still in the works.  Recommended changes have been made to the Highway Commercial.  Next, the changes will be given to the township. If the changes are approved the Planning Commission will move forward with getting the Ordinance changed over. 

SMALL CELL TOWERS:

Solicitor Roberts reported that he was hoping to get a model Ordinance, but was unable to do so.  He will look into Cranberry Township who has a similar Ordinance and get back to us at the next meeting. 

EMERGENCY WATER SOURCE:

There are still none available.  Terry Eckart will continue to check.                                                            

EMA DIRECTOR:

Still in need of a director.

TOM LONG ZONING VIOLATION:

The hearing was continued at the request of Mr. Long.  The new hearing date is scheduled for June 17, 2015 at 6:30 pm.

SHARIAH LAW:

Solicitor Roberts looked into Shariah Law and found that 16 states have introduced bills into legislation banning the law.  This is not something that the township can address, but instead needs to be addressed at the state level. 

 

NEW BUSINESS:

 

STONE CASTLE STORMWATER RUNOFF:

Previously discussed at the beginning of the meeting.

HOLD SAFE AGREEMENT FOR DACC:

DACC is seeking permission to use Legion Road for an upcoming race.  They have included a Certificate of Insurance with their request. A MOTION was made by Mr. Mullen, seconded by Mr. Powers to approve the use of the road.  Motion carried.

APPROVAL FOR PLANNING COMMISSION GRANT WRITING WORKSHOP:

Planning Commission members have requested money for a grant writing workshop.  A MOTION was made by Mr. Powers, seconded by Ms. Ebright to allocate $500.00 for 5 members to take the course.  Motion carried. 

JENNI THOMAS BUCHER LAND DEVELOPMENT PLAN

Previously discussed at the beginning of the meeting.

NOTARY RENEWAL:

Theresa Hampton requested $220.00 for the education, supplies, certification and bonding insurance for notary renewal.  A MOTION was made by Mr. Powers, seconded by Mr. Mullen to approve this request.  Motion carried. 

CODE ENFORCEMENT OFFICER’S  REPORT:

Nick Fritz, Code Enforcement Officer, reported that Solicitor Roberts provided him with a property maintenance violation notification which he hand delivered to all pertinent residents. Mr. Fritz had everyone who received a letter sign a sheet as confirmation.  The letters were delivered to 12 residents at Montour Boulevard and 6 at Perry Avenue. 

ZONING OFFICER’S REPORT:

Tim Mauk, Zoning Officer, submitted a report for the month of April, 2015, however was not present.   Nick Fritz reported on his behalf.

Mr. Fritz reported that there is still a camping trailer at 212 Legion Road.  There is also a trailer at Club and Spade Avenue which is in the floodway.  An enforcement letter went out today to the owner of that property. Mr. Mullen presented Mr. Fritz with an article from Keep Pennsylvania Beautiful, regarding surveillance camera kits to use at dump sites.  Terry Eckart reported that DEP has a program to clean up these dump sites.  He may have contact information for DEP and will try to reach someone. 

APPROVAL FOR PROPOSED CODE WORKSHOP:

A MOTION was made by Mr. Powers, seconded by Ms. Ebright, to approve a reimbursement of $125.00 to Mr. Fritz for a recent Maintenance Code Workshop. Motion carried.

GERRY POWERS RIGHT OT KNOW WORKSHOP:

 A MOTION was made by Mr. Mullen, seconded by Ms. Ebright, to pay $30.00 for Mr. Powers to attend a Right to Know Workshop.  Motion carried.   

PUBLIC WORKS REPORT:

Mr. Powers brought up the condition of Avon Avenue.  Mr. Mullen reported that Mike Hinkle has put a temporary patch down and once the patch settles they will go back and cover the area with blacktop.  

HOLLOW ROAD CULVERT:

There is some money left over from the Federal government to fix residual infrastructure damage from 2011 flood.  The Township plans to use this money to replace  two 3 foot pipes with a 5 foot pipe.

FULL DEPTH RECLAMATION PROJECT FOR TOWER DRIVE:

Plans are to repave the portion of Tower Drive from Brobst Lane to the gravel part of the road.  Mr. Mullen will talk with Greg Dibble about putting out a bid.

COL. CO. LIQUID FUELS GRANT APPLICATION FOR TOWER DRIVE & QUARRY DRIVE:

The township put in 2 grant proposals and was approved for one project – the Quarry Drive project.  The grant received was in the amount of $26,000.00.  The project is for full depth reclamation.  They will also be asking for $5,000 - $6,000 from Conservation District to put new pipes in as part of the same project.

Mr. Powers thanked Mr. Mullen for his work in getting this grant.

Police Chief Terry Eckart has submitted the following written report of activities for the month of April, 2015:

FIRE COMPANY REPORT:

Fire Chief Brian Fosse was not present but submitted a written report of Fire Company activities for the month of April, 2015.

PUBLIC COMMENT PERIOD:

There were no public comments made.

MEETING DATE:

Mr. Powers reported that the Montour Township Board of Supervisors will hold their next Monthly Meeting on June 11, 2015, at 7:30 p.m.

There being no further business to discuss, the Meeting was adjourned at 9:00 p.m., on a MOTION of Mr. Mullen, seconded by Mr. Powers.  Motion carried.
